Release of Liability and Assumption of Risk

HEALTH & FITNESS REQUIREMENTS:

Good physical health is required to participate with Carlye Cunniff (CarlyeMoves). CarlyeMoves advises consultation with a physician to ensure adequate health to safely participate in activities held by CarlyeMoves. I acknowledge that owners, instructors, teachers, agents, or operators of CarlyeMoves may lead moves that are intended to help me and my well-being. I acknowledge that owners, instructors, teachers, agents, or operators of CarlyeMoves are not licensed medical care providers and that I take ultimate responsibility for my choices. If I experience pain or discomfort during activities held at CarlyeMoves, I agree to modify instruction to suit my individual needs.

MEDIA RELEASE:

CarlyeMoves reserves the right to use photographs and videos from class for promotional purposes. By attending classes held by CarlyeMoves, I agree to allow my image to be used in such media.

COVID-19 REQUIREMENTS:

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I acknowledge that CarlyeMoves can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others. I voluntarily seek services provided by CarlyeMoves and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19.

IF ATTENDING ACTIVITIES IN PERSON, I ATTEST THAT:

I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. I have not traveled internationally within the last 14 days. I have not traveled to a highly impacted area within the United States of America in the last 14 days. I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities. I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.

I hereby release and agree to hold CarlyeMoves and associated parties harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of CarlyeMoves or that may otherwise arise in any way in connection with any services received from CarlyeMoves I understand that this release discharges CarlyeMoves from any liability or claim that I, my heirs, or any personal representatives may have with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received at CarlyeMoves.

For the benefit of everyone attending CarlyeMoves, CarlyeMoves owners, instructors, teachers, agents, or operators reserve the right to reject any participant at any time, without liability or obligation to pay a refund, in the event that they determine, in their sole and exclusive discretion, that a participant is disruptive to the experience or compromising the health and safety of other participants.

BY ATTENDING CarlyeMoves:

I wish to participate in classes taught at and by CarlyeMoves. I acknowledge that there are certain risks involved in the participation of activities related to dance, fitness, and/or yoga. In consideration of being allowed to enroll in classes at CarlyeMoves I hereby personally assume all risk in connection with the classes, including injuries or accidents incurred before, during or after class, arising from general use of the facility and/or off premises rehearsals, practices, competitions, presentations, and performances. I further release CarlyeMoves owners, instructors, teachers, agents, and operators for any injury or damage that may befall me while I am enrolled as a student or client of CarlyeMoves, including all risks connected therewith, whether foreseen or unforeseen; and further to save and hold harmless CarlyeMoves, owners, instructors, teachers, agents, or operators from any claim by me, or my family, estate, heirs, or assigns, arising out of my enrollment and participation in classes, events, workshops, or all other activities at CarlyeMoves. I further state that I understand the terms herein are contractual and not a mere recital; and that I have signed this document as my own free act. 

I have fully informed myself of the contents of this affirmation and release by reading it before I signed it. I have had a medical examination to assure myself and assume my own responsibility of physical fitness and capability to perform under the conditions of the classes offered at CarlyeMoves and am physically fit as attested by the medical examination. IN WITNESS WHEREOF, I have executed this affirmation and release at CarlyeMoves. In case that the dancer, member or client is under 18, I, parent or guardian, represent to CarlyeMoves that the facts herein concerning my child or ward are true. I hereby give my permission for my child or ward to enter classes offered by CarlyeMoves and further, in consideration of allowing my child or ward to enroll in the classes, agree individually and on behalf of my child or ward, to the terms of the above Agreement and Release of Liability.
